These Terms and Conditions apply to the services provided by Schools' Sports Limited (SSL) a Limited Company registered in England and Wales (Registration Number 5685417), and SOCS, miSOCS.com and SchoolsSports.com, trading styles of SSL, and the associated websites, systems and products of SSL shown below:

  • Any of the main modules of the SOCS system, including SOCS sport (formerly FixturesPRO), SOCS co-curricular (formerly PROactivity), SOCS website, SOCS calendar and SOCS administrator and their associated Content Management Systems (CMS) as hosted and configured on SSL servers and to any SOCS component that SSL introduces in the future.
  • Any of the sub-modules of the above. e.g. SOCS sport hub, Team Sheet Builder, Team Training Planner, Competition Builder, Big Screen, dedicated sports website and corresponding content management system, as configured to support schools, clubs or other organizations as hosted and configured on SSL servers.
  • SOCS sport dedicated sports websites and content management systems as configured or customized for individual schools and clubs.
  • The SOCS main website - miSOCS.com.
  • The Schools' Sports Website - SchoolsSports.com.
  • The Schools' Rugby Website - SchoolsRugby.co.uk.

Together with SSL's Privacy Policy, Full Copyright Notice and Data Security Policy they govern SSL's relationship with you in relation to this website, the associated websites and the services provided by SSL. SSL may change these Terms and Conditions, the Privacy policy, the Full Copyright Notice or Data Security Policy at any time. Changes will be notified to SOCS account holders when they next login to their SOCS control panels. Using or accessing this website, the associated websites, the SOCS control panel and the services provided by SSL indicates your acceptance of these terms and conditions. If you do not accept these terms and conditions please do not continue to use this website, the associated websites or the services provided by SSL.

The services and websites provided by SSL are subject to the following terms of use:

  • Your use of this website, associated websites or services and any dispute arising out of such use is subject to the laws of England and Wales.
  • This website, associated websites and services provided by SSL are made available for public viewing on the basis that SSL excludes to the fullest extent lawfully permitted all liability whatsoever for any loss or damage howsoever arising out of the use of this website, associated websites and services or reliance upon the content provided by SSL or schools using SOCS. SSL does not exclude SSL's liability (if any) to you for personal injury or death resulting from SSL's negligence, for fraud or for any matter which it would be illegal to exclude or to attempt to exclude.
  • People whose contact details are included on this website or SSL associated websites (as mentioned above) are either employees of SSL or an associated undertaking or have been uploaded using the SOCS CMS (for instance have been listed as contacts for sport by SOCS account holders).
  • SSL reserves the right to discontinue any aspect of any website or service at any time.
  • SSL supports and expects all users of its websites and services to adhere to the guidelines as set out by the Child Protection in Sport Unit (CPSU). For more information visit the CPSU website at http://www.thecpsu.org.uk/.
  • Service Level Agreement (SLA). During normal working hours, 09:00 to 17:00, Monday to Friday, SSL will aim to respond to customer support requests within 12 hours. If a request is outside of normal working hours or marked "urgent", the support team's response will be aligned with the nature of the request. Our standard SLA for service provision is 99.9% availability.
  • Annual Licenses. Schools using any of the main SOCS modules and the SOCS CMS, either collectively or individually (e.g. SOCS sport or SOCS co-curricular or SOCS calendar) or any additional module (such as Team Sheet Builder or Team Training Planner or Big Screen etc) do so under an annual license agreement, that renews automatically annually, unless cancelled (see cancellations below). Organizations using Competition Microsites or SOCS sport hub websites, which consolidate and rely on the data from clusters of schools (e.g. all schools in a County, SSLP or other geographical region) where several or all schools in a cluster use SOCS sport, or for a website catering for a single sport (NGB or sports club), or a Competition Microsite, do so under annual license that renews automatically annually unless cancelled (see cancellations below).
  • Pricing. To assist budgetary planning, SOCS main account holders will find our latest pricing via their SOCS control panel and can be confident that prices will remain static for the entire calendar year (1 January to 31 December). Pricing for setup work and licenses are reviewed in November and December annually and might change on 1st January. Price increases will be notified via a pop-up alert when a SOCS main account holder logins in to their SOCS control panel. Our latest pricing can be sent to SOCS and non-SOCS account holders on request by emailing support@misocs.com.
  • Data Protection and Retention. For personal data, SSL complies with the UK Data Protection Act. Any content (data) uploaded using the SOCS CMS (for instance SOCS sport, SOCS co-curricular or SOCS website or any sub-module, such as Team Sheet Builder or Team Training Planner, is governed by these terms and conditions. In the case of all cancellations, the license expires. At this time all personal data is deleted. The data pertaining to fixtures and competitions will be retained on the system (for instance for on-going use in the SSL sport portals) and can be requested by the former license holder in excel file format and will be available for up to 30 days following the date of cancellation. Thereafter data pertaining to fixtures and competitions may be deleted at the discretion of SSL. More details can be found in our Data Security Policy. The Data Security Policy is part of these terms and conditions.
  • IPR and Copyright The IPR and copyright of the services, system, code, software, the underlying infrastructure and configuration provided by SSL is the sole property of SSL. Reproduction is prohibited other than in accordance with the Full Copyright Notice. The Full Copyright Notice is part of these terms and conditions.
  • 3rd Party Copyright Protection. Schools must not submit to SSL, either via the SOCS content management system (CMS) or as part of SSL's school website design or sports website customization service, any material, such as designs, artwork, video, photographs or other media that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the school is the owner of such rights or has acquired the permission from their rightful owner.
  • SSL does not endorse any photograph, video or any opinion, recommendation, or advice expressed therein, and SSL expressly disclaims any and all liability in connection with photographs and videos. SSL does not permit copyright infringing activities and infringement of intellectual property rights on its websites or services, and SSL will remove all content, photographs and videos if properly notified that such infringes on another's intellectual property rights. SSL also reserves the right to remove all content, photographs and videos without prior notice.
  • SSL reserves the right to decide whether a photograph or video is appropriate and complies with these Terms and Conditions for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. SSL may remove such Videos and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice.
  • Advice. This website and associated websites contain general information and do not constitute advice on any specific sporting or other matter. Whilst SSL makes every effort to ensure that the content is accurate and up-to-date, nothing should be construed as advice. By using this website, associated websites or services you confirm that you have not relied on any such content. If you require advice on any specific sporting problem or other matter, please contact in the first instance the relevant school, club, competition organizer, website manager or National Governing Body for the sport in question.   • Parental Permission. Schools using SOCS should acquire the appropriate parental permission and copyright permission from the photographer to display images and the names of the pupils in any school, team or action photograph uploaded using SOCS, or submitted to SSL for uploading for inclusion on the sport portals or other websites.
  • Schools Advertising. This is a monthly, quarterly or annual fee subscription service. Schools using this services will be contacted to confirm continuation, normally the week before the next renewal date.
  • Supplier Advertising. This is a monthly, quarterly or annual fee subscription service. Suppliers will be contacted to confirm continuation, normally the week before the next renewal date.
  • Sports Website Customization. Schools using SSL's sports website customization service give SSL express permission to fully utilize the School's crest, brand, image and overall design layout of the School's existing website. During customization the following elements cannot be removed: 1. The footer, specifically "SOCS sport website". 2. Links to our sport portals. 3. All of the main components displayed on the home page of the sport website. 4. The gold whistle, which links to www.SchoolsSport.com.
  • Use of SSL's Whistle Logo. All sports websites during initial setup, or pending the configuration of a sports website domain name, display the SSL Grey Whistle image with a link to the home page of SchoolsSports.com. All sports websites with a domain name or customized display the Gold Whistle image, with a link to the SchoolsSports.com home page where they appear as a Featured School. These images and links are integral to SSL's system and cannot be removed.
  • Footer Text and Links. The following text appears in the footer of every school sports website, whether it has been customized or not. The footer text reads: "SOCS sport website". This text and links are integral to SSL's system and cannot be removed. Footer text will be styled appropriately for schools using SSL's sports website customization service.
  • SOCS sport. SSL undertakes to publish on the Internet, via its websites and content management systems, a school’s complete sports fixtures and results listings. Schools using SOCS sport, in planning their fixtures, and providing SSL with any related and additional information such as match dates, kick off times, venues, draws, results, player statistics, match reports, action photos, or videos (including any fixture or draw that is part of a competition organised by third parties or National Governing Bodies), give SSL their consent to include such information on any of SSL’s websites that appear on the Internet and as early as possible prior to a fixture being played. If consent is needed it is the responsibility of the school or sports club to seek consent from competition organisers or third parties to reproduce or publish on the Internet fixture lists and competition draws. SSL undertakes not to delete any valid fixture that is to be played, or has been played, from a schools fixture listing (exception is a duplicated fixture – duplications can occasionally occur in error and will normally be removed by admin). SSL also reserves the right to consolidate and group fixtures and results to provide combined views using it’s own proprietary format, for the purposes of providing team leagues, competition groupings and knock out stage/round results. This format will not necessarily replicate the format used by competition organisers.
  • Incorrect Results. SSL does not arbitrate on incorrect entry of any data such as fixtures & results or other events. The onus is on the integrity of the user community to ensure the accuracy of all data uploaded via SOCS. For example, in the event that a result is incorrect then the person spotting the error should, in the first instance, contact the school or competition organizer responsible for recording the incorrect result and request the change. The telephone and email address details of schools can be found via "Find Your School". The name of Competition Organizers can be found on the respective Competition Microsites. In the case of other websites provided by SSL, there will generally be the usual Contact Us link in the main menu or footer.
  • Recording losses as wins, deleting fixtures that are losses, organizing competition fixtures at the last minute and any other attempt to climb the Merit and League tables on the respective sport portals, or misrepresenting the facts, may result in the cancellation of the offending school’s SOCS license and removal from any competitions organized by Schools’ Sports Ltd.
  • SSL will terminate a User's access to its services if, under appropriate circumstances, they are determined to be a repeat infringer.
  • Competitions. Schools using SOCS and taking part in competitions covered by SSL should note that competition fixtures and results might be validated by the organisers and cannot be deleted from fixture lists. However, it is possible for schools using SOCS sport to edit their own competition fixtures and results, in order to add points scorers and match reports etc. Schools using SOCS sport should not, however, adjust the match type, alter the scores or attempt to record a loss as a win or reset a recorded result to 'tbc', as this will alter the overall tournament or competition group and any knockout or league table.
  • Schools responsible for arranging competition fixtures should always check with the competition organiser to ensure accuracy and timeliness.
  • Domain Name Registration.SSL registers domain names on behalf of schools. If a school wants to create a sub-domain from an existing domain, SSL will provide the necessary instructions.
  • Payment for Website Design, Build and Setup Work. Invoices are normally sent on receipt of the order (within a day or two) with payment terms set to "On Receipt". Once an order has been processed the School or individual requesting the work agrees to pay SSL for any work undertaken. This applies to any work carried out to design and build a school website, customize a sports website, setup a big screen module or any other similar undertaking. If SSL has already carried out such work and the School or individual requesting the work decides not to proceed, then payment for the work and time expended by SSL is required in full. If no work has been carried out and the School or individual requesting the work decides not to proceed, then SSL will not pursue payment.
  • Training. Invoices for training are forwarded to schools, or to individuals attending training, with payment terms set to 'On Receipt'. Unless agreed otherwise payment must be made before the training date. For later bookings (made within 14 days of the training date) payment is required at least within 7 days following the date of the training. If payment has been received a full refund will be made if the training does not go ahead and is cancelled by SSL. If payment has not been received then SSL will cancel the invoice and notify the school or individual. For bookings made 14 days or more in advance of the training date and if the original attendee (or a stand-in) does not attend and we are notified within 7 days prior to the training date then no refund will be made. If we are notified of a cancellation within 14 days to 7 days prior to training date then 50% of the training fee is payable. If we are notified of a cancellation 14 days or more in advance of the training date and payment has been received then a full refund will be made, otherwise the invoice will be cancelled. For later bookings (made within 14 days of the training date) and if the original attendee (or stand-in) does not attend and we are notified of cancellation within 72 hours prior to the training date, then payment is required in full, otherwise 75% of the training fee appearing on the invoice is payable. In this case, if payment has been made SSL will refund 25% of the training fee, otherwise, if payment has not been received, SSL will cancel the original invoice and re-send an amended invoice for 75% of the training fee.
  • Invoicing and Payment Terms. Invoices for our services will normally be sent to a school's finance department or to the individual requesting the work, unless we are notified otherwise. In most cases our payment terms are set to "On Receipt" of our invoice. Payment terms for other website design services will be agreed on a case-by-case basis.
  • Invoicing and Annual Renewals. SOCS licenses (e.g. SOCS sport site license or School Website license) renew automatically every twelve months unless SSL receives written notification of cancellation. (See cancellations below). The minimum term of all licenses is 12 months. In the first year payment is due in full within the first 30 days of use and then during the stipulated Billing Month (see below) in subsequent years. An invoice for the annual license fee, including any modular add-ons, such as Team Sheet Builder, will be sent to the School's finance department annually during the School's Billing Month, with payment terms set to "On Receipt".
  • Billing Month. The Billing Month is the month during which the license commenced and the month when annual renewals are due. The Billing Month can be provided on request and is generally the month in which the first invoice was sent unless alternative arrangements have been agreed. If you need to change your Billing Month please contact us.
  • Non-Payment Procedure. Regular demands for payment will be made if an initial or renewal invoice remains unpaid. If the license has not been cancelled in writing (see cancellations below) and after a reasonable period of attempted recovery has lapsed, a FINAL DEMAND will be issued and sent to the school or individual requesting payment within 28 days and the CMS and all user accounts will be frozen at this time. In the case of schools the FINAL DEMAND will be sent to the Principal or the Director of Finance and Cc'd to the Director of Sport. If we do not have a response within the 28 day period from the date of issue of the FINAL DEMAND then the following can be expected:
    1. The license will be suspended.
    2. The CMS and all user accounts will be disabled.
    3. The school website, sports website, all content and data will be frozen and made inaccessible except via the SSL sport portals.
    4. Payment of the original invoice sent will be due in full if the license is in the first 12 months.
    5. If the license is in the 2nd or subsequent years then the original invoice will be voided and a "cancellation invoice" will be sent to the school for the period of service utilised. This will be calculated based on the period from the 1st day of the Billing Month to the date of issue of the FINAL DEMAND plus 28 days.
    6. If, after a further period of 28 days, either invoice (at 4 or 5) remains unpaid we will take legal representation to recover all costs.
  • Cancellation. Four weeks notification of cancellation is required in writing from a SOCS main account holder, or from the individual requesting the original work and should be sent by email to support@misocs.com. Cancellation by telephone or from other sources, such as personnel in Accounts Departments or other third parties, who might not be fully aware of the SOCS service provision, will not be accepted.
  • Refunds. No refunds will be made for cancellations.
  • Domain Name Cancellation. Four weeks notification of cancellation is required in writing from a SOCS main account holder, or from the individual requesting the domain name, and should be sent by email to support@misocs.com. Cancellation by telephone or from other sources, such as personnel in Accounts Departments or other third parties, who might not be fully aware of the SOCS service provision, will not be accepted.
  • Links to Websites. From time to time this website and associated websites may include links to other 3rd party websites. These links might provide additional information but are not intended to signify that SSL endorses such website and/or content. SSL has no responsibility for the content of third party linked websites. It is your responsibility to check the terms and conditions of any other websites you may visit.
  • Any license holder using SSL services may create links to SSL's websites from their website(s).
  • Other Schools and other organisations may create links to SSL's websites from their website(s) once SSL has granted permission.
